Definitions
APPLICATION: The Lullbeat mobile application and related platforms that allow users to record, review, and track fetal heart monitoring sessions.
USERS: Every person who downloads or uses the Application.
COMPANY: LyHorizon (owner and operator of the Application).
MONITORING RESULTS: Heart rate estimates, session statistics, audio recordings, and related outputs generated by the Application during or after a monitoring session.
SERVICES: The Application, the LyHorizon website, and any other products or platforms we offer in connection with Lullbeat.
AGREEMENTS: These Terms of Use and our Privacy Policy.
LINKED SITES: Any third-party websites, applications, or services linked from or accessed through the Services.
1. Acceptance of Terms of Use Agreement
By downloading or using the Application, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you may not use the Application.
We may modify these Agreements at any time, including to reflect legal updates, new features, or business changes. Updates will be posted in the Legal section of the app and on our website. Continued use after changes become effective means you accept the new terms.
These Terms supersede any prior agreements and govern your relationship with the Company.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. The Application is intended for expecting parents and adult caregivers.
By using the Services, you confirm that:
- You can form a binding contract
- You are not prohibited from using the Services under applicable law
- You comply with all applicable laws and these Terms
- If using the Services on behalf of an entity, you have authority to bind that entity
3. Rights We Grant You
You receive a limited, personal, worldwide, non-transferable, revocable license to use the Services for personal, non-commercial purposes in accordance with these Terms and applicable app store rules.
You agree not to:
- Use the Services commercially without our consent
- Copy, modify, reverse engineer, decompile, or exploit any content or software
- Interfere with operations, security, or networks
- Use bots, scrapers, crawlers, or unauthorized automation
- Upload malware or attempt to bypass security
- Develop third-party integrations without permission
- Misrepresent Monitoring Results as clinical diagnoses or medical certifications
- Use the Application in medical emergencies instead of contacting emergency services
Violations may result in suspension, termination of access, and legal action where permitted by law.
4. Rights You Grant Us
You retain ownership of your content, including profile information, session data, and audio recordings stored on your device.
By using the Services, you grant us a worldwide, royalty-free license to host, display, process, and use your content only to the extent necessary to operate, maintain, and improve the Services, comply with law, and enforce these Terms.
In the current version, most content remains on your device and is not uploaded to our servers unless we clearly disclose otherwise and obtain your consent.
We may review or remove content that violates these Terms where technically feasible and legally required.
Feedback you provide may be used without compensation.
The current version of the Application does not display third-party advertising within the monitoring experience.
5. Wellness & Medical Disclaimer
Lullbeat is a wellness tool and is not a medical device. The Application does not diagnose, treat, cure, or prevent any disease or condition.
Monitoring Results are provided for personal informational purposes only and may vary based on device, positioning, gestational age, and other factors. They are not a substitute for professional medical advice, prenatal care, or clinical fetal monitoring equipment.
Always consult your healthcare provider for medical questions, concerns, or before making health-related decisions.
6. Privacy
See our Privacy Policy for details on data collection, microphone access, storage, and use.
7. Respecting Rights
You may not use the Services to:
- Violate privacy, intellectual property, or other legal rights
- Harass, defame, threaten, or promote hate or violence
- Submit unlawful, harmful, or misleading content
- Collect personal data illegally
- Impersonate others or misrepresent your identity
You may not use the Services for unlawful purposes.

8. Payments & Subscriptions
Some features may require a paid subscription or in-app purchase. You agree to pay applicable fees through your chosen payment provider.
Payments renew automatically unless cancelled in your Apple App Store account settings at least 24 hours before renewal.
Prices, billing periods, free trials, and premium features are shown in the Application at the time of purchase.
No refunds except where required by applicable law or app store policy. Refund requests for Apple purchases are handled according to Apple’s policies.
9. Data Charges
You are responsible for any mobile data, internet, or carrier fees incurred while using the Services.
10. Third-Party Services
Third-party services accessed through the Services — including Apple App Store billing and iOS system services — are governed by their own terms and privacy policies.
We are not responsible for third-party services we do not control.
11. Indemnity
You agree to indemnify and hold harmless the Company, its affiliates, officers, employees, and partners against claims, damages, losses, and expenses arising from your content, your misuse of the Services, or your violation of these Terms or applicable law.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
We do not guarantee that Monitoring Results will be accurate, complete, or available at all times. We do not guarantee uninterrupted operation, error-free performance, or absolute security.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the maximum extent allowed by law, the Company and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Services.
To the maximum extent allowed by law, our total liability for any claim arising out of these Terms or the Services will not exceed the greater of USD $100 or the amount you paid us in the past 12 months.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Venue
Except where mandatory consumer protection laws require otherwise, any dispute arising out of or relating to these Terms or the Services will be handled in the courts of the jurisdiction in which LyHorizon is established, unless we agree in writing to a different venue.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16. Microphone & Audio Data
Microphone access is used solely to enable fetal heart monitoring sessions and local session playback.
In the current version, audio data is stored locally on your device and is not sold or shared with data brokers.
Audio and session data are retained on your device until you delete sessions, clear app data, or uninstall the Application, unless we clearly disclose otherwise in an updated Privacy Policy.

17. Final Terms
These Terms constitute the entire agreement between you and the Company regarding the Services and replace all prior agreements on the same subject.
You may not transfer your rights or obligations under these Terms without our consent.
We may assign our rights and obligations as part of a merger, acquisition, or sale of assets.
If there is any conflict between translations of these Terms, the English version controls.
